Right of revocation
1. The buyer has the right to revoke his agreement on the conclusion of the contract declaration of intent within one week of receipt of the goods without giving reasons. The revocation is in writing (e.g. letter, fax, e-mail) or by returning the goods to the seller. The time limit begins after receipt of this instruction in text form, however not before receipt of the goods by the recipient (in case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and also not before fulfillment of our information obligations according to § 312c paragraph 2 BGB in connection with § 1 Sections 1, 2 and 4 BGB-as well as our obligations according to § 312e Section 1 Clause 1 BGB in connection with § 3 BGB Information Regulations. 2. In case of an effective withdrawal, the mutually received services are to be returned and any benefits (e.g. interest) surrendered. If the buyer can only return the good(s) received in part, or in a deteriorated condition, he must pay the seller compensation for the value of the good(s). With the release of goods this does not apply if the deterioration is exclusively due to their inspection as it would have been possible in a shop. Moreover, if the obligation to pay compensation for damaged goods is to be avoided by the buyer, they must return the items wholly unused and intact. Pact transportable items are to be returned at Galeria Eldorado’s risk.
3. The buyer has to bear the cost of returning the goods if the delivered goods ordered corresponds and if the price of the returned goods does not exceed an amount of 40 Euros or if the buyer at a higher priced item has not yet provided the contractually agreed partial payment. Otherwise the return shipment is free of charge for the buyer. Non transportable items are picked up from the buyer. Obligations for reimbursement payments must be fulfilled within 30 days. The period begins for the buyer with the dispatch of the revocation or the goods and for the Seller upon receipt.
